Terms of service

These terms are between DarkForge Labs Ltd (company number 17033392, “we”) and the business that signs up to Elumina (“you”). Elumina is for businesses, not consumers. By creating an account you agree to these terms on behalf of your business.

The service

Elumina is a till, back office and online booking system that runs in a web browser. The parts you can use depend on the plan and modules you pay for. Elumina needs an internet connection to work.

Your account

• Keep your sign-in details and staff PINs private. You are responsible for what happens under your account.
• Only give access to people who work for your business, at the role they need.
• Give us accurate details, and keep them up to date.

Fees and payment

• You pay monthly, in advance, at the prices shown on our prices when you subscribe. We charge your card through Stripe.
• We take no share of your sales and charge your customers no booking fee.
• Card payments from your customers go through your own account with Stripe or Dojo, under that provider’s terms. Their fees are between you and them.
• If we change our prices, we will tell you at least 30 days before your next bill at the new price.

Cancelling

There is no minimum term. Cancel at any time from Settings, then Billing. You keep access until the end of the month you have paid for, and we do not refund part months. We may suspend an account whose payment fails and is not put right within 14 days.

Your data and your customers’ data

• The data you put into Elumina, including your customers’ details and your sales, belongs to you.
• For your customers’ personal data, you are the controller and we are your processor. We process it only to run Elumina for you and on your instructions, keep it confidential and secure, use only the providers listed in our privacy policy, help you answer your customers’ requests about their data, tell you without undue delay about any breach that affects it, and delete or return it when you leave.
• You are responsible for having a lawful reason to collect your customers’ data and for telling them how you use it.

Acceptable use

Do not use Elumina to break the law, to sell anything illegal, to send spam, or to try to reach another business’s data. We may suspend an account that does, and will tell you why.

Availability and support

We work to keep Elumina running and to fix faults quickly, but we do not promise it will never be unavailable. Support is by email at support@elumina.co.uk, 9am to 5pm, Monday to Friday, except UK bank holidays.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, we are not liable for loss of profit, revenue or goodwill, or for indirect loss, and our total liability in any 12 months is limited to the fees you paid us in those 12 months.

Changes to these terms

We may update these terms. We will email account holders at least 30 days before a material change takes effect. If you do not agree, you can cancel before then.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction.
